En particular, se trata la cuestión de la secularización de la ley en la antigüedad y en la modernidad. El atomismo histórico es una respuesta a la pregunta «¿qué es la historia?», quizá el límite de la objetividad de una mirada a lo histórico. El atomismo histórico es una filosofía de la historia sin relato, sin visiones holísticas de la historia. Considera la historia conformada por hechos independientes e irreductibles unos a otros, átomos históricos, una respuesta ontológica por cuanto reduce la historia a un mero agregado de acontecimientos en temporalidad. No reflexiona sobre lo que el hombre es, sino (...) sobre lo que el hombre ha hecho, interesa su obra total resultado de la actividad manipuladora de la realidad, lo que llama estructura. La historia no es nada más que la colosal acumulación de hechos históricos fruto de la libertad, la libertad es el gran corolario de esta doctrina, de los sujetos que los llevaron a cabo, que han implicado una novedad influyente en la estructura. El atomismo histórico es una filosofía de la historia formal. Se deja a los historiadores la tarea de la descripción concreta de los hechos históricos y de las agrupaciones de estructuras que conforman cada período histórico. Y como pura forma, no sólo carece de relatos concretos sino que además imposibilita un relato holístico. (shrink)

En este artículo se estudia el aporte del jesuita Francisco Suárez, en el contexto de la Escuela Ibérica de la Paz y del humanismo escolástico, para orientar moral y jurídicamente las interacciones socio-jurídicas de diversos actores en el conjunto de la humanidad desde el ideal del _bien común de la humanidad_. Para ello, empleamos una metodología de análisis, como es la intercultural, que trata de dar cuenta de forma comparada de la posible pertinencia e interés de una tradición particular, como (...) la que dimana de la Escuela Ibérica de la Paz, para iluminar desafíos comunes de la humanidad; así como de los supuestos fundamentales que están dinamizando esta tradición. Se identifica esta propuesta como una modernidad cosmopolita, con realizaciones históricas y contribuciones doctrinales que nos muestran otras tradiciones de origen europeo que representan una articulación ética ante la diversidad de la humanidad desde el Renacimiento. Posteriormente, se analizan los elementos esenciales que configurarían el bien común de la humanidad desde la contribución de Suárez. Y finalmente se examina la dimensión ética y antropológica del dinamismo de la praxis que posibilita una convivencia ética en la plural comunidad universal de la humanidad. (shrink)

Las universidades jesuitas, en cuanto instituciones que participan de la misión de la Compañía de Jesús han de dar respuesta desde sus funciones a la superación de las fracturas sociales y ecológicas que proliferan en la sociedad global. Esto implica un esfuerzo continuado de traducción e internalización universitaria de esta misión en todas sus actividades propias. En este artículo trataremos de acercarnos a algunas de las implicaciones que tiene esta misión para la vida de las universidades jesuitas. Plantearemos una visión (...) de conjunto de la misión conforme a las últimas congregaciones generales así como el contexto científico y cultural en el que esta traducción universitaria puede darse. Consideraremos en qué líneas puede aportar la propia tradición cultural y espiritual jesuita al tratamiento de la cuestión social y la cuestión ecológica y qué implicaciones tiene esta misión en cuanto a la docencia y aprendizaje, investigación y proyección social en las universidades jesuitas. Given the potential that environmentally oriented anti-consumption (EOA) has in achieving environmental sustainability, the authors draw upon marketing, management, environmental, and psychology studies to conceptualize and delimit EOA, differentiating it from other (related but distinct) phenomena. In addition, the authors review the available literature at the individual (micro) level and summarize research on the antecedents and meanings of broad and specific/strict EOA practices with different targets. Furthermore, the authors propose an agenda for future research, which reflects on EOA not only (...) at the individual (micro) level, but also lays out new opportunities for EOA work at organizational (meso), industry, and national (macro) levels. The work presented here hopes to spark multilevel research on EOA, its antecedents and consequences, and reactions to EOA phenomena. (shrink)

The scope and particular focus of an advanced practice nurse’s role is highly variable and thus the ethical challenges they face are equally diverse. Yet, the dominant existing ethics pedagogies used in the nursing context have been described as not fit-for-purpose. Existing pedagogies do not adequately prepare APN candidates to meet the ethical challenges they will encounter in practice. Applying an arts-based pedagogy in ethics education for (...) advanced practice nurses has the capacity to provide effective ethics learning. This article reports on the value of a multidisciplinary pedagogy used in a graduate course in nursing leadership, law and ethics for advanced practice at an Australian university. Written in a multidisciplinary mode that allies with the pedagogy it presents, it addresses the key pedagogical challenges and opportunities of teaching ethics through an innovative arts-based pedagogy centred upon the changing depictions of the human person in works of art housed in a major state-funded art gallery. RESUMO O presente estudo analisa a narrativa de Milton Hatoum utilizando como corpus as crônicas “Um sonhador” e “Margens secas da cidade”. Objetiva problematizar as características discursivas e estéticas da criação literária de Hatoum, a partir da perspectiva dialógica proposta por Mikhail Bakhtin, explorando, no discurso artístico-literário do escritor amazonense, as posições axiológicas refratadas em sua narrativa. Relaciona ainda a perspectiva epistemológica de Boaventura Santos acerca do desperdício da experiência social na modernidade/pós-modernidade, discutindo a crítica ao paradigma da racionalidade atual (...) denominado pelo autor de razão indolente. As análises iniciais alicerçadas nestas abordagens teórico-metodológicas evidenciam indícios, na narrativa cronística de Hatoum, que a aproxima de uma perspectiva contra-hegemônica e responsiva de representação literária. Pretende, assim, com esta inter-relação entre literatura, dialogismo e teoria do conhecimento, evidenciar as imbricações existentes entre o discurso sócio-histórico-econômico produzido pela crítica à modernidade/pós-modernidade e o discurso literário de Milton Hatoum. ABSTRACT This study analyzes Milton Hatoum’s narrative using the crônicas Um sonhador [A Dreamer] and Margens secas da cidade [Dry Riverbanks of the City] as corpus. It aims to ascertain the discursive and aesthetic characteristics of Hatoum’s literary creation from the dialogical perspective proposed by Mikhail Bakhtin, exploring the artistic-literary discourse of the Amazonian writer, the axiological positions refracted in his narrative. It also relates Boaventura Santos’ epistemological perspective about the waste of social experience in modernity/post-modernity, discussing the criticism of the paradigm of current rationality called by the author as indolent reason. Initial analysis based on these theoretical-methodological approaches show evidence in Hatoum’s cronistic narrative that brings it closer to a counter-hegemonic and responsive perspective of literary representation. Thus, with this inter-relationship among literature, dialogism and theory of knowledge, we intend to highlight the existing overlaps between the socio-historical and economic discourse produced by the critique of modernity / postmodernity and literary discourse of Milton Hatoum. Recent sequencing of the metazoan Oikopleura dioica genome has provided important insights, which challenges the current understanding of eukaryotic genome evolution. Many genomic features of O. dioica show deviation from the commonly observed trends in other eukaryotic genomes. For instance, O. dioica has a rapidly evolving, highly compact genome with a divergent intron‐exon organization. Additionally, O. dioica lacks the minor spliceosome and key DNA repair pathway genes. Even with a compact genome, O. dioica contains tandem repeats, comparable to other eukaryotes, (...) and shows lineage‐specific expansion of certain protein domains. Here, we review its genomic features in the context of current knowledge, discuss implications for contemporary biology and identify areas for further research. Analysis of the O. dioica genome suggests that non‐adaptive forces such as elevated mutation rates might influence the evolution of genome architecture. The knowledge of unique genomic features and splicing mechanisms in O. dioica may be exploited for synthetic biology applications, such as generation of orthogonal splicing systems. (shrink)

A química e a física, em seu contexto histórico e cultural, se desenvolveram paralelamente no escopo da filosofia natural, e a química em especial, com elementos oriundos da medicina metalurgia e alquimia. O caráter tecnológico, pragmatismo e desinteresse metafísico dos químicos aliado a uma visão reducionista da química a física foram obstáculos relevantes para desenvolvimento tardio de uma filosofia da química. O uso de métodos analíticos de investigação química, como a espectroscopia, evidencia estreita relação histórica entre química e física na (...) prática química. bem como, os modelos de atômicos fundamentados na mecânica quântica. A química é uma disciplina autônoma e distinta da física, porém, do ponto de vista metafísico e ontológico suas entidades, teorias e leis podem ser distinguíveis? Metodologicamente a física pode ser usada para compreender a química? E do ponto de vista epistemológico as explicações em química são redutivas a física? O ponto central é saber se a química é redutível “em princípio” a física. Sobre essas questões, muito tem se escrito, porém, gostaríamos de refletir sobre este problema a partir da perspectiva da filosofia dos aspectos modais de Herman Dooyeweerd afim de verificar se sua visão filosófica-ontológica pode oferecer uma contribuição na discussão minimamente satisfatória ao problema do reducionismo da química à Física. Leibniz’s De incerti aestimatione, which contains his solution to the division problem, has not received much attention, let alone much appreciation. This is surprising because it is in this work that the definition of probability in terms of equally possible cases appears for the first time. The division problem is used to establish and test probability theory; it can be stated as follows: if two players agree to play a game in which one has to win a certain number of (...) rounds in order to win the pool, but if they break the game off before either of them has won the required number of rounds, how should the pool be distributed?Our article has two aims: it provides the readers with the first published English translation of De incerti aestimatione, and it also gives them a brief commentary that explains Leibniz’s philosophical and mathematical concepts necessary in order to understand this work. The translation is as literal as possible throughout; it shows how Leibniz struggled at times to find a solution to the division problem and how he approached it from different angles. The commentary discusses Leibniz’s views on four key concepts: fairness, hope, authority and possibility. The commentary then outlines how Leibniz attempted to solve the problem of division. The long 19th century was a period of many developments and technical innovations in agriculture and animal biology, during which actors sought to incorporate new practices in light of new information. By the middle of the century, however, while heredity steadily became the dominant concept in animal husbandry, some policies related to livestock improvement in Brazil seemed to have been tailored following a climate-deterministic concept established in the mid-18th century by the French naturalist Georges-Louis Leclerc, the Comte de Buffon. His (...) theory of animal degeneration posited, among other things, the necessity of recurrent crossbreeding to preserve animal species living in nonnative environments from climate-induced degeneration. Although largely discredited by the early 19th century, the teachings of the French naturalist seem to have found supporters in a Brazilian program to modernize national agriculture through the application of the natural sciences. Herein I examine the revival of Buffon’s theories in that government-sponsored program to improve animal husbandry and breeding techniques, including actual applications of this theory in the real world. Ultimately, I argue that Buffon’s theory of degeneration was used to tailor public policies and funding for the improvement of domesticated animals in Brazil between 1856 and 1860. (shrink)

O presente artigo trata de um objeto da História da Filosofia. Sendo assim, objetiva analisar as correlações literárias dos textos de Timaeus 71E - 72B, Symposium 202E – 203A e Phaedrus 244B-244E em relação ao Corpus Hermeticum 12.19, com a finalidade de encontrar supostas fontes enquadradas no texto hermético, e saber como elas foram retrabalhadas nele. Assim, busca perguntar pela origem, história, significado e aplicação de motivos que incidem nos textos cotejados, incluindo o Corpus Hermeticum 12.19, perscrutando as correlações histórico-religiosas (...) a fim de encontrar nexos traditivos comparáveis do mundo filosófico-religioso contemporâneo do Corpus Hermeticum 12.19. Em particular, este artigo demonstra que o Corpus Hermeticum 12.19 descreve a arte divinatória ou das artes mânticas através da inspiração, aruspício e augúrio. Pode-se vislumbrar o tema da comunicação entre Deus e o homem através das artes mânticas. Por último, o presente artigo, tomando como base o enfoque helenista, aventa que o Corpus Hermeticum XII.19 tem influência médio-platonista. (shrink)

El artículo busca desarrollar cómo es que dentro del filme Aloners (2021) se desenvuelve una crítica a la violencia positiva que identifica a la sociedad capitalista contemporánea. Para conseguir esta meta, el escrito se divide en tres momentos: el primero, que desarrolla el modo en que se entiende el trabajo muerto dentro del filme; el segundo, que se ocupa de profundizar en el modo en que se producen patologías sociales desde el ejercicio de una violencia positiva sobre la subjetividad del (...) sujeto y; finalmente, se recurre a la hauntología para poder comprender la función del fantasma en la cinta, develando así la crítica detrás de este mismo. De este modo, la hipótesis central del texto es que dentro de Aloners existe todo un aparato crítico hacia las formas de vida contemporáneas sometidas por la dominación total del trabajo en todos los aspectos de la existencia. O presente trabalho expõe de que forma a educação pode ser utilizada como ferramenta emancipatória para a superação do capital, tendo como base teórica o pensamento de István Mészáros. O principal objetivo dos que lutam contra a sociedade mercantil, a alienação e a intolerância, é a emancipação humana. Objetivo este alcançado quando o ser humano finalmente compreende, seja teoricamente ou na prática, todas as características de funcionamento de sua sociedade e de seu gênero, de tal forma que a luz científica (...) não seja algo que o cegue, mas que o faça ver onde seus olhos não alcançam. Tendo em vista o objetivo de transformar qualitativamente as condições objetivas da reprodução social, István Mészáros entende que há a necessidade de reconquistar o controle do capital enquanto estrutura, e não enquanto instância personificada do sistema capitalista e também transformar progressivamente as consciências. Considera-se então que para trabalhar as consciências, de acordo com o autor, fica evidente a relação entre educação e trabalho: uma vez que, cabe à educação elaborar tantas estratégias apropriadas, elaboradas e adequadas para transformar as condições objetivas de reprodução, como para a automudança consciente dos indivíduos chamados a concretizar a criação de uma ordem social metabólica radicalmente diferente, esta seria o socialismo. The critical concern of the present volume is contemporary naturalism, both in its scientific version and as represented by newly emerging hopes for another, philosophically more liberal, naturalism.1 The papers collected here are state-of-the-art discussions that question the appeal, rational motivations, and presuppositions of scientific naturalism across a broad range of philosophical topics. As an alternative to scientific naturalism, we offer the outlines of a new non- reductive form of naturalism and a more inclusive conception of nature than any provided (...) by the natural sciences. Our authors collectively believe that holding scientific naturalism up for philosophical scrutiny and challenging its misconceptions is of the first importance both for understanding ourselves and our place in the world; and, also, for the future direction of philosophy itself. Normativity concerns what we ought to think or do and the evaluations we make. For example, we say that we ought to think consistently, we ought to keep our promises, or that Mozart is a better composer than Salieri. Yet what philosophical moral can we draw from the apparent absence of normativity in the scientific image of the world? For scientific naturalists, the moral is that the normative must be reduced to the nonnormative, while for nonnaturalists, the moral is that (...) there must be a transcendent realm of norms. _Naturalism and Normativity_ engages with both sides of this debate. Essays explore philosophical options for understanding normativity in the space between scientific naturalism and Platonic supernaturalism. They articulate a liberal conception of philosophy that is neither reducible to the sciences nor completely independent of them—yet one that maintains the right to call itself naturalism. Contributors think in new ways about the relations among the scientific worldview, our experience of norms and values, and our movements in the space of reason. Detailed discussions include the relationship between philosophy and science, physicalism and ontological pluralism, the realm of the ordinary, objectivity and subjectivity, truth and justification, and the liberal naturalisms of Donald Davidson, John Dewey, John McDowell, and Ludwig Wittgenstein. En el presente artículo tratamos algunos de los desafíos que un constitucionalismo global tiene actualmente respecto a la consecución de una justicia cosmopolita: pluralismo jurídico más allá del monismo jurídico y cultural del Estado moderno, sociodiversidad e interculturalidad, y sostenibilidad socioecológica de los modos de vida legitimados jurídicamente. Para ello consideraremos cómo entiende la tradición escolástico-católica de la Modernidad temprana las exigencias de lo común que atraviesan todo fenómeno jurídico en la vida colectiva y entre los pueblos, atendiendo específicamente a (...) algunas contribuciones clave de Francisco Suárez. De otra parte, como contrapunto del humanismo escolástico católico trataremos la visión de la Modernidad liberal, la cual plantea un modelo racional unívoco y ahistórico de configuración tanto de las exigencias de justicia entre los pueblos, como del modo de propiedad, el cual se identifica con una única forma de propiedad individual desvinculada de las exigencias del bien común. Today most philosophers in the English-speaking world adhere to “naturalist” credos that philosophy is continuous with science, and that the natural sciences provide a complete account of all that exists. This volume presents a group of leading thinkers who criticize scientific naturalism in order to defend a more inclusive or liberal naturalism.

In this paper, we will survey the different uses of the term algorithm in contemporary legal practice. We will argue that the concept of algorithm currently exhibits a substantial degree of open texture, co-determined by the open texture of the concept of algorithm itself and by the open texture inherent to legal discourse. We will substantiate our argument by virtue of a case study, in which we analyze a recent jurisprudential case where the first and second-degree judges have carved-out contrasting (...) notions of algorithm. We will see that, thanks to our analysis of the open texture of the notion of algorithm in legal language, we can make sense of the different decisions taken by the judges as different contextually-determined sharpenings of the concept of algorithm. Finally, we will draw some general conclusions concerning the use of technical terms in legal instruments that address new technologies, such as the EU AI Act. (shrink)

The extent to which game play is experienced as engaging is an important criterion for the playability of video games. This study investigates how video games can be designed towards increased levels of experienced engagement over time. For this purpose, two experiments were conducted in which a total of 35 participants repeatedly played a video game. Results indicate that experienced engagement is based on the extent to which the game provides rich experiences as well as by the extent to which (...) the game provides a sense of control. In view of the influence of both game features and players’ expertise on the levels of experienced richness and control, it is concluded that game features should be modified over time to maintain optimal levels of engagement.
